  1. House Plans Are Copyrighted
    Just like books, songs and movies, federal law protects the intellectual property of architects and home designers. These protections start as soon as the designer puts the design on the computer (or paper) and prevents anyone from using the design without permission.
  2. Do Not Copy Any Design From Any Type of Publication, Electronic Media or Home
    It is illegal to copy, change, or redraw designs found in any form of media including the internet. The right to modify plans is one of the exclusive rights copyright. It is also illegal to copy or redraw a constructed home that is protected by copyright, even if you have never seen the plans of the home. If you find a plan of home you like, you must purchase a set of plans from the original source. The plans cannot be lent, given away, or sold by the purchaser.
  3. Plans Are For The Right To Build Only One Home.
    The original purchaser of the plans is licensed to build only one home unless written permission has been granted by the original designer.
  4. Reproducing Blueprints
    Plans, blueprints, or blacklines unless they are reproducibles, cannot be copied or reproduced without prior written permission of the copyright owner. Blueprinters and copy shops are prohibited from making copies of these plans without the copyright letter you received with the reproducible plans.
  5. Who Is Responsible For Copyright Infringement?
    Any party who takes part in the copyright violation. It does not matter whether or not the individual knows that a violation is being committed. Ignorance of the law is not a valid defense.
  6. Penalties For Infringement
    Penalties for violating a copyright may be very severe. The responsible parties are required to pay the designer’s actual damages plus any profits made. The copyright law also allows  the designer to recover statutory damages which can be as high as $100,000.00. Lastly, the infringer can be required to pay the designer’s reasonable attorney fees which often exceed the damages.
